01 / TERMS

Use of the website

palfora.com describes the services of Palfora, a software studio based in Austin, Texas, and shows selected work. By using the site you agree to these terms. If you do not agree with them, please do not use the site.

You may browse, link to and quote the site for lawful purposes. You may not interfere with the site or its contact endpoint, bypass the verification or rate limiting on the contact form, send automated or bulk submissions, probe the site for vulnerabilities without permission, or use it to distribute malware or unlawful content.

Use of the contact form is also covered by the privacy policy.

No professional advice

Content on this site, including material about payment processing, processing costs, PCI DSS scope and security, is general information drawn from Palfora’s experience. It is not legal, financial, tax, accounting or compliance advice, and it is not a substitute for a qualified adviser, a PCI Qualified Security Assessor or your acquiring bank.

Palfora designs systems with compliance scope in mind. It does not certify compliance for any business, and nothing on this site should be read as an assurance that a system, product or service is compliant with any standard.

Enquiries and proposals

Submitting the contact form is a request for a conversation, not an order. Any budget range, estimate or timeline mentioned on this site or in early correspondence is indicative. Palfora’s obligations to a client begin only when a written agreement is signed by both parties, and that agreement takes precedence over these terms for the work it covers.

Intellectual property

The text, layout, diagrams, wordmark and code of this site belong to Palfora [or its licensors, to be confirmed] and are protected by copyright and trademark law. You may not reproduce them for commercial purposes without written permission.

Product names, screenshots and marks shown on the Work pages belong to their respective owners and appear only to describe those products; nothing on this site transfers any right in them. Third-party names such as Cloudflare, Apple, WordPress and EmDash are the marks of their owners and are used only to identify the products they refer to.

No warranties

The site is provided as is and as available. Palfora makes no warranty that it will be uninterrupted, error-free or free of harmful components, or that its content is complete, accurate or current. Descriptions of capabilities, products and technologies reflect the time of writing and may change without notice.

Limitation of liability

To the fullest extent permitted by law, Palfora is not liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profit, revenue, data or business, arising from the use of or inability to use this site or its content, even if advised of the possibility of such loss.

Where liability cannot be excluded, it is limited to the greatest extent the law allows. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law.

Governing law

These terms are governed by the laws of [Jurisdiction to be confirmed], without regard to its conflict-of-law rules. Any dispute about this site will be brought in the courts of [Venue to be confirmed], and you agree to their jurisdiction.

[Consider whether the law of the State of Texas and the courts of Travis County, Texas, are appropriate; confirm with counsel.]

Changes to these terms

Palfora may update these terms. The version on this page, with the date shown at the top, is the one in force. Continued use of the site after a change means you accept the updated terms.
